The regulations of the online store VEL LEES defining the rules for the fulfillment of orders placed through the website vellees.pl

§ 1
GENERAL PROVISIONS

1. This Regulation is the regulation referred to in Article 8 of the Act of July 18, 2002, on the provision of services by electronic means (Journal of Laws No. 144, item 1204, as amended).
2. This Regulation defines the rules for Users' use of the online store available at the internet address vellees.pl (hereinafter referred to as: VEL LEES or online store VEL LEES).
3. Registration and use of the online store VEL LEES is conditional upon acceptance of the provisions of this Regulation. Each Customer VEL LEES declares that they have read its content before concluding the contract.

§ 2
DEFINITIONS

1. Data Controller - Silvexcraft Mateusz Wójcik Sp. k. based in Tyczyn, ul.Orkana 5, 36-020 Tyczyn, with the following numbers: NIP: 5170373027, REGON: 363361395, KRS: 0000588340, email address: support@vellees.com.
2. Cookies – small text information created by the User's web browser, assisting the operation of the program.
3. VEL LEES – retail sales system in the form of an online store, operating at the address vellees.pl, owned by Silvexcraft Mateusz Wójcik Sp. k. based in Tyczyn, ul. Orkana 5, 36-020 Tyczyn, with the following numbers: NIP: 5170373027, REGON: 363361395, KRS: 0000588340, enabling the placement and acceptance of orders for jewelry articles, perfumes, and other accessories.
4. Password – a unique string of characters (numbers or letters) chosen by the Customer, which the Customer assigns in the online store system VEL LEES for the purpose of confirming their identity.
5. Consumer – A client who is a natural person, using the online store VEL LEES, particularly making purchases for purposes not directly related to their business or professional activity, in accordance with Article 221 of the Act of April 23, 1964 – Civil Code.
6. Client – Consumer, Entrepreneur on consumer rights, or Entrepreneur who uses the Store, particularly placing an Order or entering into a Sales Agreement with the Seller.
7. Login – the Client's identifier in the online store VEL LEES.
8. Entrepreneur - a natural person, legal person, or organizational unit that is not a legal person, which the law grants legal capacity, conducting business or professional activity in their own name, in accordance with Article 431 of the Civil Code.
9. Entrepreneur on consumer rights - a natural person entering into a sales contract with VEL LEES directly related to their business activity, when the content of this contract indicates that it does not have a professional character for them, resulting in particular from the subject of the business activity they perform, made available under the provisions of the Central Register and Information on Business Activity; the provisions of the Regulations concerning Consumers apply to such a person to the extent resulting from absolutely binding legal provisions.
10. Store – online store VEL LEES operated by Silvexcraft Mateusz Wójcik Sp. k. at the internet address vellees.pl .
11. Seller – Silvexcraft Mateusz Wójcik Sp. k. based in Tyczyn at ul. Orkana 5, 36-020 Tyczyn, KRS: 0000588340, NIP: 5170373027, REGON: 363361395.
12. Product - jewelry, perfumes, and possibly other products available in the current offer of the online store VEL LEES, which may be the subject of sale.
13. Sales Agreement – a sales agreement for the Product concluded between the Customer and the Seller through the Store.
14. User - any person using the website of the online store VEL LEES.
15. Order – an order for the Product or Products placed by the Customer in the online store VEL LEES, aimed directly at concluding a sales agreement with the Seller.

§ 3
REGISTRATION

1. Registration in the online store VEL LEES allows the Customer to:
   1. enter, edit, or delete data, including delivery addresses;
   2. place orders using the data provided by the Customer;
   3. create a shopping list;
   4. view order history;
   5. subscribe to and unsubscribe from the newsletter;
   6. use other functionalities available to registered Customers.
2. To register in the online store VEL LEES (create a Customer account), it is necessary to fill out the online registration form, providing first and last name, email address, password, landline or mobile phone, residential address, and in the case of registering a business account: company details (company name, company address, VAT ID). Optionally, gender and date of birth can be provided.The Client is obliged to familiarize themselves with the provisions of this Regulations at the latest at the moment of placing the first order.
3. After completing and submitting the registration form by the Client, VEL LEES, a confirmation of registration is sent to the email address provided by the Client. From this moment, the registration process is completed.
4. Registration in the online store VEL LEES, as well as using the functionalities of the online store VEL LEES are free of charge. Completing the registration means that the Client enters into an agreement with VEL LEES for the provision of electronic services consisting of maintaining the Client's account, under the terms specified in this Regulations.
5. After registering in the online store VEL LEES, each subsequent login is done using the data provided in the registration form or subsequently changed via the Client's account settings.
6. The account created as a result of registration is maintained for the Client for an indefinite period. The Client may resign from the account in the online store VEL LEES and request its deletion at any time. No fees are charged for resignation and account deletion.
7. Any Client VEL LEES may delete their own account at any time by sending an email with the content: "Please delete the account: _______" (indicate the name of the registered Client). The message requesting account deletion should be sent from the address associated with the Client's account that the registered Client wishes to delete from the VEL LEES service database. All emails regarding the deletion of a given Client's account should be sent to the email address: support@vellees.com . Account deletion occurs immediately and signifies the termination by the Client of the agreement with VEL LEES for the provision of electronic services, which involves maintaining the Client's account.

§ 4
TERMS OF USE OF THE ONLINE STORE VEL LEES

1. The ability to use the services of the online store VEL LEES is available to all Internet Users, provided that the Client's IT system meets the following minimum technical requirements:
   1. having access to the Internet service;
   2. having a functional, broadband web browser;
   3. having an active email account.
2. Placing orders in the online store VEL LEES is possible 24 hours a day, every day of the year, except for times when the website cannot be displayed due to maintenance breaks or other technical reasons. Order fulfillment takes place on business days.
3. The customer of the online store VEL LEES is obliged to use the services of the online store VEL LEES in accordance with applicable law, the provisions of these Terms and Conditions, as well as the principles of social coexistence and good manners.
4. The customer of the online store VEL LEES may not:
   1. use the online store VEL LEES for purposes other than those resulting from its nature and subject;
   2. promote other websites by placing addresses of other online stores on the website VEL LEES, as well as advertising or promoting their own business;
   3. negatively affect the functioning of the online store VEL LEES m.in. through actions using viruses or other computer codes, files, or programs that interrupt, destroy, or limit the operation of the online store VEL LEES or computer hardware, or in any other way enable unauthorized use or access to a computer or computer network;
   4. take actions through which a person or entity carrying them out can influence other Customers, as well as act to the detriment of Customers, Administrators, or other third parties;
   5. use materials posted within the online store VEL LEES for purposes other than those permitted for personal use.
5. The Customer is obliged to keep the login and password to their account in the online store VEL LEES confidential.Within the limits set by applicable legal regulations, the Client is responsible for all actions related to the use of the login and password for a given account in the online store VEL LEES, with the password being confidential information exclusively known to the Client.

§ 4 A
INTELLECTUAL PROPERTY

1. The online store VEL LEES and all content contained therein, including in particular: the name VEL LEES, verbal and graphic designations, logos, photographs, graphics, descriptions, texts, advertising materials, as well as designs, patterns, and concepts of products offered by VEL LEES, including in particular jewelry designs, diagrams, space radiators, and other original products, are protected by law under applicable legal regulations.
2. The protection referred to in paragraph1. In particular, the elements that constitute works within the meaning of copyright law, trademarks, industrial designs, business identifiers, elements of visual identification, as well as other results of creative or intellectual activity related to the activity VEL LEES.
3. All intellectual property rights to materials, content, designs, and other elements referred to in this paragraph, to the extent that they are subject to legal protection, belong to VEL LEES and are protected in particular by the provisions of:
   1. the Act of February 4, 1994 on Copyright and Related Rights,
   2. the Act of June 30, 2000 – Industrial Property Law,
   3. the Act of April 16, 1993 on Combating Unfair Competition.
4. Without prior explicit consent VEL LEES, subject to cases permitted by applicable law, it is prohibited in particular to:
   1. copying, duplicating, reproducing, recording, modifying, distributing, publishing, sharing, or using in whole or in part the content and materials posted in the online store VEL LEES for commercial, advertising, promotional, or other purposes exceeding fair use;
   2. copying, reproducing, or using designs, patterns, forms, compositions, layouts, decorations, symbols, graphics, themes, or other distinctive features of products offered by VEL LEES, including in particular jewelry designs, diagrams, space radiators, and other copyrighted products, in a manner that infringes the rights of VEL LEES or constitutes an act of unfair competition;
   3. the introduction to circulation, offering, promoting or selling products that are copies, imitations or adaptations of products VEL LEES, if it infringes VEL LEES rights or constitutes an act of unfair competition;
   4. the use of photos, visualizations, product names, product descriptions, marketing materials or other materials belonging to VEL LEES in commercial, advertising or promotional activities without the consent of VEL LEES;
   5. downloading, copying or reusing data or information available in the online store VEL LEES in a manner that may infringe the interest of VEL LEES.
5. It is also prohibited to undertake any actions aimed at reproducing the products offered by VEL LEES in whole or in part, including based on photographs, descriptions, dimensions, visualizations, graphics, or other materials provided by VEL LEES, if such actions lead or may lead to the infringement of intellectual property rights VEL LEES or constitute an act of unfair competition.
6. In the event of an infringement of intellectual property rights VEL LEES , VEL LEES is entitled to take all actions provided for by law, in particular to demand the cessation of infringements, removal of their effects, compensation for damages, return of unjustly obtained benefits, as well as to pursue claims through court proceedings.
7. The provisions of this paragraph do not limit the protection granted to VEL LEES under mandatory legal regulations.

§ 5
PERSONAL DATA

1. Personal data provided by Customers in the online store VEL LEES (including during the account registration process, while using the online store VEL LEES, including making purchases in the online store VEL LEES), is processed by Silvexcraft Mateusz Wójcik Sp. k. based in Tyczyn, ul. Orkana 5, 36-020 Tyczyn, with the following numbers: NIP: 5170373027, REGON: 363361395, KRS: 0000588340 (data controller).
2. Providing personal data by the Customer is voluntary; however, it is necessary for making purchases and using the services provided electronically by VEL LEES, which require the provision of personal data. VEL LEES processes personal data in order to provide services electronically, to enter into and execute sales contracts for products ordered by the Customer in the online store VEL LEES, and, if the Customer has given consent as referred to in § 16 sec. 1 of these Terms and Conditions, also for the purpose of providing the newsletter service.
3. The Customer has the right to access the content of their personal data and to correct and delete it. Personal data can be corrected or deleted after logging into the Customer's account. By providing data, the Customer declares that the personal data provided by them is their own data.
4. Detailed provisions regarding the protection of the Customer's personal data in connection with the applicable Regulation of the European Parliament and of the Council (EU) 2016/679 of April 27, 2016.In relation to the protection of natural persons in connection with the processing of personal data and the free movement of such data, and repealing Directive 95/46/EC (GDPR), information can be found on the website of the online store VEL LEES in the Privacy Policy.

§ 6
DETAILS OF THE PRODUCTS

1. VEL LEES reserves that the images of the Products presented on the website VEL LEES may slightly differ from the actual appearance of the product, particularly due to the individual settings of the Client's device, lighting during the photo shoot, the specifics of jewelry, stones, coatings, or shades of the metal.
2. The dimensions of products offered by VEL LEES, such as: length, width, diameters of products or holes in specific products are for informational purposes and may slightly differ from the actual dimensions of the described products by about 5% (in words: five percent), which is a result of the specificity of the products and their very small sizes.
3. The provisions of this paragraph do not limit the rights of the Consumer or the Entrepreneur on consumer rights arising from the regulations on the lack of conformity of the Goods with the contract.

§ 7
PRICES AND TAXES

1. The prices of goods offered by VEL LEES are gross prices, including applicable taxes.
2. The price for a purchase made at VEL LEES, which binds the Customer, is the price of the Goods stated at the moment the Customer expresses the intention to enter into a contract on the website of the online store VEL LEES increased by the shipping costs of the Goods to the address indicated by the Customer.
3. In the case of delivery of Goods to an address located outside the customs area of the European Union, the Customer may be required to incur additional import charges, in particular customs duties, import VAT, fees related to customs clearance, and other charges imposed by the destination country or relevant authorities or entities participating in the import procedure. Unless explicitly stated otherwise in the online store VEL LEES, these charges are not included in the price of the Goods or in the delivery cost and are the responsibility of the Customer.

§ 8
TERMS OF USE OF DISCOUNT CODES

1. VEL LEES hereby declares that all discount codes granting the Customer the right to receive a specified percentage discount, upon entering the indicated code that reduces the order value, do not accumulate with other active promotions and discounts, and also do not apply to the discounting of gold jewelry of 585 fineness offered by VEL LEES.
2. Discount codes apply to silver jewelry of 925 purity, silver jewelry of 925 purity covered with 18-carat gold, and perfumes VEL LEES.

§ 9
ORDER FULFILLMENT

1. Step 1 – Payment for the placed Order. The fulfillment of the Order begins upon the posting of the payment amounting to 100% of the Order value by VEL LEES.
2. Step 2 – Documenting the payment. VEL LEES upon recording the settlement of the Order payment will issue the appropriate sales document in the legally prescribed form.

§ 10
ORDER CONFIRMATION

1. Placing an Order constitutes an offer by the Customer to purchase the Goods that are the subject of the order.
2. After placing the Order VEL LEES sends an email to the address provided by the Customer in the form, containing information that serves as confirmation of the order registration, which is a statement VEL LEES of acceptance of the offer made by the Customer, subject to § 11 sec. 3.
3. On the website VEL LEES clearly indicates, in a clear and readable manner, information about the method of delivering Goods and accepted payment methods.
4. No later than at the moment the Customer expresses the will to enter into a contract with VEL LEES, through clear and understandable information placed on the online store's website, VEL LEES fulfills the information obligations, including m.in. those specified in Article 12 of the Act of May 30, 2014 on consumer rights, in particular information regarding the main features of the service VEL LEES, labeling VEL LEES, total price, and the right to withdraw from the contract.
5. Immediately before placing the order VEL LEES provides the Customer with clear and visible information on the website about the main features of the service, including the subject of the service and the method of communication with the Customer, the total price for the Goods including taxes, as well as charges for transport, delivery, and courier services.
6. VEL LEES ensures that the Customer explicitly confirms at the time of placing the Order that they are aware that the order entails an obligation to pay, which occurs by clicking the "Confirm order with payment obligation" button.
7. If VEL LEES cannot fulfill the service because the subject of the service is not available, it will notify the Customer at the email address or by phone provided when placing the order and will refund the amounts paid without delay, no later than within 14 days from the conclusion of the contract in the case where the Customer has chosen the prepayment option.

§ 11
SHIPPING OF GOODS, ORDER FULFILLMENT TIME

1. The standard shipping procedure for the Order includes one consolidated shipment of the entire Goods ordered by the Customer from a given Order.
2. The VEL LEES system automatically calculates the delivery cost of the Goods to the Customer, providing the shipping price along with the value of the ordered Goods.
3. In cases where, due to a non-standard Order, particularly the weight, dimensions of the Goods, or delivery location, the automatic determination of the delivery cost is not possible or requires an individual quote, VEL LEES will inform the Customer of the delivery cost before the Sales Agreement is concluded. The Sales Agreement will be concluded only after the Customer has accepted the total price, which includes the price of the Goods and the delivery cost.
4. After the VEL LEES purchased goods are shipped, the Customer will receive an email with the details of the placed Order, including the type of ordered Goods and their price along with shipping costs. After the VEL LEES ordered Goods are shipped, the Customer will receive information about the shipment to the address provided by the Customer.
5. The Order processing time is the time counted from the next business day following the day on which the funds were credited to the company's account until the day the order is handed over to the courier company:
   • from 1 - 3 business days for standard product orders,
   • from 1 - 5 business days for personalized/custom product orders,
   • mixed orders (standard product and personalized product) are treated as personalized/custom product orders.
6. Delivery time for the Order:
   • Inpost Parcel Lockers: 1 – 2 business days, only within Poland.
   • DHL Courier: 1 - 2 business days, only within Poland.
   • Fedex Courier: 1–7 business days to European Union countries (usually 1–3 business days).
   • Fedex Courier: 7–30 business days to countries outside the European Union.
7. VEL LEES informs that during the holiday season (Easter, Christmas), during Valentine's Day, International Women's Day, Black Friday, as well as during other periods of increased Order volume, the processing time may be extended – up to a maximum of 14 business days.
8. Free shipping is available depending on the order value and the delivery country.

§ 12
PAYMENTS

1. The Client has the option to make payments for the Goods through the payment systems Stripe, PayPal, PayU, and Klarna, as well as cash on delivery if such a method is available for the given Order.
2. In the event of a need to refund the amount for a transaction made by the Client using a payment card, VEL LEES will refund the aforementioned amount to the bank account linked to the Client's payment card, subject to § 15 sec. 17.
3. VEL LEES may limit the Client's ability to choose cash on delivery for subsequent Orders if the Client has not correctly received a cash on delivery shipment at least twice and has not previously submitted a statement of withdrawal from the contract or provided a justified reason for the failure to collect the Order.The above limitation does not exclude the possibility for the Customer to place an Order using other payment methods available in the online store VEL LEES.
4. At the same time, VEL LEES indicates that failure to collect a cash on delivery shipment does not equate to withdrawal from the contract. In the event of not collecting the cash on delivery shipment without prior withdrawal from the contract or without another justified reason, VEL LEES may seek compensation from the Customer on general principles, in particular for the reimbursement of actually incurred and documented shipping costs and the return of the shipment, unless the law provides otherwise.

§ 13
PICKUP IN PERSON

1. Customers purchasing jewelry in the online store VEL LEES have the option to collect their order in person at the company's headquarters in Tyczyn near Rzeszów (address: ul. Orkana 5, 36-020 Tyczyn).
2. The option to collect a placed order in person at the company's headquarters is available after previously selecting the option: Personal Collection in the order form.
3. Personal collection of placed orders can be made at the company's headquarters from Monday to Friday between 7:00 AM and 3:00 PM, after receiving confirmation of order fulfillment and readiness for collection via email / SMS.

§ 13 A
PROMOTIONS 2 + 1

1. The promotion applies to all Goods available in the store VEL LEES excluding products from the PROMOTIONS tab and gift cards.
2. The promotion consists of granting a discount in the cart for the entire order amounting to 50% of the price of the cheapest product from the three selected.
3. Every customer of the store VEL LEES can participate in the Promotion, provided that during the Promotion period they purchase three products from any category covered by the promotion (or any subsequent multiple of 3 products), of which 50% of the value of the cheapest one will reduce the order cost.
4. The customer can participate in the Promotion any number of times, provided that they meet the conditions described in paragraph 3 above (bundled sales) each time.
5. Participation in the Promotion means acceptance of these Terms and Conditions.
6. The Promotion cannot be combined with other promotions, discounts, or special offers available in the store VEL LEES.
7. Withdrawal from the contract for products purchased in the "2+1 – third item at 50% discount" promotion is possible in full or in part.If, as a result of a partial withdrawal from the contract or a partial return of Goods, the conditions of the Promotion are no longer met, VEL LEES is entitled to recalculate the value of the Order taking into account the loss of the promotional discount. The above does not limit the statutory right of withdrawal from the contract granted to the Consumer or the Entrepreneur on consumer rights.
8. Detailed information regarding withdrawal from the contract and returns can be found in § 14 Withdrawal from the contract and § 15 Complaints.

§ 14
WITHDRAWAL FROM THE CONTRACT

1. Subject to paragraph.4. The Client, being a Consumer or an Entrepreneur on consumer rights, who has entered into a VEL LEES distance sales agreement or an agreement outside the business premises, has the statutory right to withdraw from the agreement within 30 days from the date of taking possession of the Goods, and in the case of an agreement covering multiple Goods delivered separately, in batches, or in parts — from the date of taking possession of the last Goods, batch, or part, without providing a reason and without incurring costs, except for the direct costs of returning the Goods. In the case of withdrawal from a distance agreement or an agreement concluded outside the business premises, the agreement is considered not concluded.
2. In order to exercise the aforementioned right, the Consumer or Entrepreneur on consumer rights submits to VEL LEES a declaration of withdrawal from the agreement, the template of which is included in Appendix No. 1 to the regulations. Using the template for the withdrawal form is not mandatory.
3. In the event of withdrawal from the contract in the manner specified in § 14 sec. 1 of the Regulations, the Consumer or Entrepreneur on consumer rights is obliged to return the complete Product along with additional accessories that are an integral part of it - if they were attached to the Product (e.g. during promotional campaigns) and, if possible, the purchase document, and in the absence of such, another document confirming the transaction made in the store VEL LEES - to VEL LEES at the following address:

4. The right to withdraw from the contract does not apply to the Consumer or Entrepreneur on consumer rights in cases specifically defined in art. 38 of the Act of May 30, 2014 on consumer rights m.in. In the event that the subject of the service is a non-prefabricated item, produced according to the specifications of the Consumer or Entrepreneur on consumer rights, serving to meet their individualized needs.
5. VEL LEES refunds the Consumer or Entrepreneur on consumer rights all payments made, including the costs of delivering the Goods corresponding to the cheapest standard delivery method offered by VEL LEES , no later than 14 days from the day of receiving the statement of withdrawal from the contract. If the Client chose a delivery method other than the cheapest standard delivery method offered by VEL LEES, VEL LEES is not obliged to refund the additional costs incurred by the Client.
6. The Consumer or Entrepreneur on consumer rights, exercising the statutory right of withdrawal from the contract, bears only the direct costs of returning the item to VEL LEES.
7. VEL LEES may withhold the refund of payments received by the Consumer or Entrepreneur on consumer rights until the item is returned or the aforementioned person provides proof of its return, depending on which event occurs first.
8. VEL LEES refunds the amount for the returned Goods using the same payment method that the Consumer or Entrepreneur on consumer rights used, unless they have agreed to a different method of return that does not incur any costs for them.
9. The Consumer or Entrepreneur on consumer rights is responsible for the decrease in the value of the Goods resulting from using them in a manner that exceeds what is necessary to ascertain the nature, characteristics, and functioning of the Goods.
10. The Consumer or Entrepreneur with consumer rights is obliged to return the Goods without delay, no later than 14 days from the day on which they withdrew from the contract. To meet the deadline, it is sufficient to send back the Goods before its expiration.

§ 15
COMPLAINTS

1. VEL LEES is liable to the Consumer and the Entrepreneur with consumer rights for the lack of conformity of the Goods with the contract under the principles specified in the Act of May 30, 2014, on consumer rights.
2. Complaints regarding Goods ordered in the online store VEL LEES should be submitted to the email address: support@vellees.com or in writing to the address: Silvexcraft Mateusz Wójcik Sp. k., ul. Orkana 5, 36-020 Tyczyn.
3. Submitting a complaint can be done using the complaint form available on the online store's website: Complaint-Form. Using the complaint form is not mandatory.
4. The complaint should include data enabling the identification of the Customer and the Order, a description of the identified non-compliance of the Goods with the contract, and the Customer's request. The absence of the indicated elements does not render the complaint ineffective if its consideration is possible based on the provided information.
5. If the Goods are non-compliant with the contract, the Consumer or Entrepreneur on consumer rights may request their repair or replacement.
6. VEL LEES may carry out the replacement when the Consumer or Entrepreneur on consumer rights requests repair, or VEL LEES may carry out the repair when the Consumer or Entrepreneur on consumer rights requests replacement, if bringing the Goods into compliance with the contract in the manner chosen by the Customer is impossible or would require excessive costs for VEL LEES.
7. If repair and replacement are impossible or would require excessive costs for VEL LEES, VEL LEES may refuse to bring the Goods into compliance with the contract.
8. VEL LEES undertakes the repair or replacement within a reasonable time from the moment it has been informed by the Consumer or Entrepreneur with consumer rights about the lack of conformity of the Goods with the contract, and without excessive inconvenience to the Customer, taking into account the specifics of the Goods and the purpose for which the Goods were purchased.
9. The Consumer or Entrepreneur with consumer rights provides VEL LEES the Goods subject to repair or replacement. VEL LEES collects the Goods from the Customer at its own expense or agrees with the Customer on another method of delivering the Goods without excessive inconvenience to the Customer.
10. If, after the initial analysis of the complaint submission or after examining the Goods, it turns out that the complaint is not justified, VEL LEES will inform the Customer of the reasons for the refusal to acknowledge the complaint and will agree with the Customer on the method of collection or return of the Goods.This provision does not exclude the possibility of pursuing claims against the Client on general principles, in particular for the reimbursement of actually incurred and documented costs, if the complaint was obviously unfounded, abusive, or made in bad faith.
11. The Consumer or Entrepreneur with consumer rights may submit a declaration of price reduction or withdrawal from the contract if:
    1. VEL LEES refused to bring the Goods into compliance with the contract in accordance with section 7;
    2. VEL LEES did not bring the Goods into compliance with the contract in accordance with section.8;
    3. the non-conformity of the Goods with the contract still exists, despite VEL LEES attempting to bring the Goods into conformity with the contract;
    4. the non-conformity of the Goods with the contract is significant enough to justify a price reduction or withdrawal from the contract without prior recourse to a request for repair or replacement;
    5. from the statement VEL LEES or circumstances, it is clear that VEL LEES will not bring the Goods into conformity with the contract within a reasonable time or without excessive inconvenience to the Consumer or Entrepreneur with consumer rights.
12. The Consumer or Entrepreneur with consumer rights cannot withdraw from the contract if the non-conformity of the Goods with the contract is insignificant. It is presumed that the non-conformity of the Goods with the contract is significant.
13. VEL LEES refunds the Consumer or Entrepreneur on consumer rights the amounts due as a result of exercising the right to reduce the price without delay, no later than 14 days from the date of receiving the statement of price reduction.
14. In the event of withdrawal from the contract due to the lack of conformity of the Goods with the contract, the Consumer or Entrepreneur on consumer rights returns the Goods VEL LEES without delay, at the expense of VEL LEES. VEL LEES refunds the price without delay, no later than 14 days from the date of receiving the Goods or proof of its return.
15. VEL LEES will respond to the submitted complaint within 14 days from the date of its receipt. If VEL LEES does not respond to the complaint within this period, it is considered that the complaint has been accepted.
16. VEL LEES is responsible for the lack of conformity of the Goods with the contract existing at the time of delivery and revealed within two years from that moment, unless the shelf life of the Goods for use, specified by VEL LEES, its legal predecessors, or persons acting on their behalf, is longer.
17. Refunds are made using the same payment method that the Consumer or Entrepreneur with consumer rights used, unless the Consumer or Entrepreneur with consumer rights explicitly agrees to a different method of refund that does not incur any costs for them.
18. Complaints regarding the non-performance or improper performance of electronic payment services made using a payment card or other payment instrument can be directed to VEL LEES to the extent that the complaint concerns the execution of the Order, or directly to the relevant payment service provider, in accordance with the rules of service provision by that provider.
19. Complaints regarding the provision of services by VEL LEES electronically, particularly concerning technical issues and the functioning of the website vellees.pl , Customers can submit via email to the address: support@vellees.com along with a detailed description of the technical problem. VEL LEES reviews complaints regarding services provided electronically within 14 days from the date of their receipt.
20. Liability VEL LEES towards a Client who is not a Consumer or an Entrepreneur under consumer rights for warranty claims regarding physical and legal defects of the Goods, as referred to in Articles 556 k.c. – 576 k.c. , is excluded, and for improper performance or non-performance of the contract is limited to actual damage and to the amount of the price paid for the Goods to which the claim relates, excluding lost profits, unless the damage was caused intentionally or mandatory provisions of law state otherwise.
21. Complaints will be considered based on the content of the document confirming the purchase of the Goods from VEL LEES or other data allowing VEL LEES to establish the conclusion of the sales contract.

§ 16
NEWSLETTER

1. The Client may give separate consent to receive the newsletter service (subscription).The newsletter service involves the periodic sending of a newsletter VEL LEES to the provided email address, containing information about promotions, new products, and special offers. Subscription to the newsletter is made by selecting the appropriate option in the registration form, during the order placement, or through a special form available on the Store's website.
2. The newsletter subscription is voluntary and free of charge. Consent to receive the newsletter is independent of consent to the terms of the Regulations and can be withdrawn at any time without affecting the fulfillment of placed orders. The newsletter service is provided for an indefinite period, until the Customer cancels it or the Store ceases to provide it, of which the Customer will be informed in advance.
3. The customer may unsubscribe from the newsletter at any time by clicking the unsubscribe link included in each newsletter message or by contacting the Store's customer service at the email address: support@vellees.com. Rezythe cancellation is effective immediately, no later than within 48 hours of its submission.
4. In order to provide the newsletter service, VEL LEES processes the customer's personal data in the form of an email address, as well as other data voluntarily provided during newsletter registration. Providing data is voluntary, but necessary to use the newsletter service.
5. To handle the newsletter dispatch, VEL LEES uses the services of Klaviyo, Inc. based in the United States. As a result, personal data may be transferred outside the European Economic Area. Detailed information about the basis for data transfer, the security measures applied, and the data recipients can be found in the Privacy Policy.
6. The customer has the right to:
   a) access their personal data, rectify it, delete it, or limit its processing,
   b) data portability,
   c) withdraw consent to receive the newsletter at any time,
   d) object to the processing of data for direct marketing purposes,
   e) lodge a complaint with the supervisory authority (President of the Personal Data Protection Office).
7. Detailed information regarding the processing of personal data, including legal bases and protection principles, can be found in the Privacy Policy.

§ 17
VALIDITY

1. If any provision of the Regulations is deemed invalid by a final court ruling, the remaining provisions shall remain in force.

§ 18
DECLARATIONS VEL LEES

1. VEL LEES hereby declares that the composition of the offered VEL LEES metal elements for jewelry production (produced or imported by Silvexcraft Mateusz Wójcik Sp. k.) is detailed in the description of each of the offered products.

§ 19
GOVERNING LAW

1. The governing law for the agreement between the Client and VEL LEES, which concerns the services provided by VEL LEES under the terms specified in the Regulations, is Polish law. By accepting the content of these Regulations, the Parties hereby choose Polish law as the governing law. The choice of Polish law does not deprive the Consumer of the protection granted to them under the mandatory provisions of the law of the country in which the Consumer has their habitual residence, if according to the relevant legal provisions, those provisions apply.

§ 20
OUT-OF-COURT DISPUTE RESOLUTION

In the event that the complaint procedure does not yield the expected result for the Consumer, the Consumer may take advantage of m.in. the following:

• mediation conducted by the relevant regional Provincial Inspectorate of Trade Inspection, to which a request for mediation should be submitted;
• assistance from the relevant regional permanent consumer arbitration court operating at the Provincial Inspectorate of Trade Inspection, where an application for consideration of the case before the arbitration court should be submitted;
• free assistance from the municipal or district consumer ombudsman.

§ 21
FINAL PROVISIONS

1. VEL LEES uses cookies necessary for the proper functioning of the site.Other cookies, particularly analytical, advertising, marketing, or personalization cookies, are used solely based on the User's consent expressed through the consent management mechanism available in the Store. The User can change the cookie settings at any time, including withdrawing the consent given. Detailed information can be found in Privacy Policy.
2. VEL LEES reserves the right to change these Terms and Conditions for a valid reason, which is:
   1. the necessity to adapt the Terms and Conditions to legal regulations that have a direct impact on these Terms and Conditions and result in the need to modify the Terms and Conditions to ensure compliance with the law;
   2. the necessity to adapt the Terms and Conditions to recommendations, orders, rulings, decisions, interpretations, guidelines, or decisions of authorized public authorities;
   3. the expansion or change of the functionality of the online store VEL LEES including the introduction of new services provided electronically or changes to existing functionalities of the online store VEL LEES;
   4. changes in the technical conditions for providing services electronically;
   5. the necessity to remove ambiguities, errors, or typographical mistakes that may have occurred in the regulations;
   6. change of contact details, names, identification numbers, email addresses or links included in the regulations;
   7. prevention of abuse;
   8. improvement of customer service;
   9. change of the contract conclusion process via the online store VEL LEES.
3. The amended Terms and Conditions will be made available in the online store VEL LEES. Customers with an account will be informed about the change in the Terms and Conditions VEL LEES by sending a message to the email address associated with their account at least 14 days before the amended Terms and Conditions come into effect, unless mandatory legal provisions or a decision by the relevant authority require a shorter period.
4. The amended Terms and Conditions are binding for the Customer who does not terminate the account management agreement in the online store VEL LEES (does not resign from the account under the terms specified in § 3 sec. 7 of these Terms and Conditions) before the date of entry into force of the amended regulations.
5. The change in the Terms and Conditions will not affect orders placed before such a change, which are being processed under the previous terms.
6. These Terms and Conditions are effective from June 5, 2026.
7. Any disputes that may arise from the cooperation between the Client and VEL LEES, concerning the provision of services by VEL LEES, which cannot be resolved through a complaint procedure or amicable settlement, will be settled by the common court competent for the registered office of VEL LEES. The above indication of the local jurisdiction of the court does not apply to Clients VEL LEES who are Consumers or Entrepreneurs under consumer rights, for whom the competent court will be the appropriate Polish common court.
8. In matters not regulated by these Terms and Conditions, the relevant provisions of the Civil Code and other applicable laws shall apply.
